The Bowery Mixed -Use Project 3. Revisions to the Draft EIR <br />The impact significance header on Page 5.9-21, Section 5.7.6, Environmental Impacts, is revised as <br />follows: <br />Less than Significant Impact with Mitigation Incorporated. <br />The first paragraph on Page 5.9-22, Section 5.7.6, Environmental Impacts, is revised as follows: <br />As described previously, JWA is located approximately 2.2 miles southwest of the Project site under the <br />primary aircraft approach corridor and within the AELUP Notification area and planning area boundary for <br />the airport. Table 5.9-2 provides an assessment of the proposed Project's consistency with the JWA AELUP. <br />As detailed, the proposed Project would be consistent with airport land use plan policies with-irnplemetifafien <br />The last row of Table 5.9-2 on Page 5.9.23, Section 5.9.6, Environmental Impacts, is revised as follows: <br />Policy 3.3.6: Condition which may serve to mitigate a <br />project/action and thus may permit the ALUC to make a <br />finding of consistency includes providing noticing that <br />states "Notice of Airport in Vicinety: This property is <br />presently located in the vicinity of an airport, within what <br />is known as an airport influence area. For that reason, <br />the property may be subject to some of the annoyances <br />or inconveniences associated with proximity to airport <br />operations (for example: noise, vibration, or odors). <br />Individual sensitivities to those annoyance; can vary from <br />person to person. You may wish to consider what airport <br />annoyances, if any, are associated uirh the property <br />before you complete your purchase and determine <br />.whether they are acceptable to you' <br />Consistent. As describedl in Section 57 <br />Hazards and Hazardous Materials, and Section 5 10 <br />Noise. the Proiect site is not located within 1 WA's Airport <br />Safety Zone as shown in Figure 5 7-11 and is located <br />outside of the airports 60 CNEL contours (F'aures 6 7-2 <br />and 5 7-3)Table 1 of the Airport Environs Land Use Plan <br />for John Wayne Airport shows that residential land uses <br />outside of the 60 CNEL contour are "normally cnns'stent " <br />Therefore, the proposed Project would not be subiect <br />to noise, vibration or odors related to JWA and is <br />consistent ith Policy 3.3.6. <br />The third row of Table 5.9-2 on Page 5.9-26, Section 5.9.6, Environmental Impacts, is revised as follows: <br />Policy 2.1: Comply with FAA regulations and ALUC <br />requirements on new development and redevelopment <br />located within the height restriction zone for JWA per <br />PUC Section 21676. <br />Consistent. According to the General Plan Airport Environs <br />Element, the Project site is not located within the Airport Environs <br />Land Use Plan (AELUP) Notification Area for JWA. k�Afsoo <br />the site is not within the FAR Part 77 200-foot height restriction <br />area. In addition, the highest point of the Project buildings .would <br />be 94-feet from ground level. Thus, the proposed Project would <br />not exceed the 200-foot high height restriction zone for JWA, and <br />the proposed Project is consistent with Policy 2.1. <br />The fifth and sixth rows of Table 5.9-2 on Page 5.9-26, Section 5.9.6, Environmental Impacts, is revised <br />as follows: <br />City of Santa Ana <br />Final EIR <br />April 2020 <br />3-6 <br />75C-969 <br />
