the Contractor shall confer annually to assess the City's outreach/education progress, <br />compliance status, and to determine if the public education and outreach consultants <br />contract shall be extended by an additional 12 months. <br />4.4.8 Battery Recycling Program <br />Contractor shall provide and service as many battery Recycling containers as requested <br />by City, to City facilities for no additional cost. Contractor shall Collect and replace <br />containers upon City's request for proper Recycling of batteries. <br />4.4.9 Procurement of Recovered Organic Waste Products <br />Contractor shall procure sufficient California derived compost, mulch, and/or <br />renewable natural gas (RNG) to meet the City's requirement for recovered organic <br />waste products of .08 tons per capita per year as specified in SB 1383. Contractor may <br />meet this obligation by one or a combination of the following activities: <br />• Bulk Compost and/or Mulch Reserved for Jurisdiction -Contractor shall make <br />available for City Compost or Mulch in an amount requested by City for use at <br />City parks and facilities at no cost to the City. Contractor shall be responsible for <br />finding end -users for any remaining Compost or Mulch. <br />• Compost Giveaway as described in Section-4.5.4. <br />• Use of renewable natural gas in Collection vehicles. <br />Contractor shall ensure sufficient capacity of California recovered organics waste <br />products to meet the mandatory procurement requirements for jurisdictions contained <br />in SB 1383, as may be amended, during the term of this Agreement including <br />Agreement extensions granted by the City. <br />4.4.9.1 Contractor Warranty of Recovered Organic Waste Products <br />Contractor shall provide assurance through the execution of a liability waiver stating <br />that all organic waste products provided by the Contractor and used within the City are <br />free from pathogens and inorganic waste material that may be harmful to the health <br />and welfare of the City and its constituents, and also in accordance with standards of <br />CalRecycle and subject to the United States Composting Council guidelines requiring <br />testing demonstrating that fecal coliform levels of <1000 MPN/gram of dry compost or <br />Salmonella < 3MPN/ 4 grams of dry compost.
