Uniform complaint procedures shall also be used to address any complaint alleging:
<br />1. Prohibition against requiring students to pay fees, deposits, or other charges for participation in
<br />educational activities, the requirements for the development and adoption of a school safety plan, and
<br />state and/or federal laws in adult education programs, and special education programs. North Orange

<br />2. Unlawful discrimination, including discriminatory harassment, intimidation, or bullying, in ROP programs
<br />and activities against any person based on his/her actual or perceived characteristics of race or ethnicity,
<br />color, ancestry, nationality, national origin, immigration status, ethnic group identification, age, religion,
<br />marital, pregnancy, parental status, physical or mental disability, sex, sexual orientation, gender identity,
<br />gender expression, or genetic information, or any other characteristics identified in Education Code 200
<br />or 220, Government Code 11135, or Penal Code 422.55, or based on his/her association with a person
<br />or group with one or more of these actual or perceived characteristics (5 CCR 4610).
<br />3. Bullying in ROP programs and activities, regardless of whether the bullying is based on a person's actual
<br />or perceived characteristics of race or ethnicity, color, ancestry, nationality, national origin, immigration
<br />status, ethnic group identification, age, religion, marital, pregnancy, parental status, physical or mental
<br />disability, sex, sexual orientation, gender, gender identity, gender expression, or genetic information, or
<br />any other characteristic identified in Education Code 200 or 220, Government Code 11135, or Penal
<br />Code 422.55, or based on his/her association with a person or group with one or more of these actual or
<br />perceived characteristics.
<br />4. ROP noncompliance with the requirement to provide reasonable accommodation to a lactating student
<br />on the school campus to express breast milk, breastfeed an infant child, or address other breastfeeding-
<br />related needs of the student (Education Code 222).
<br />5. ROP noncompliance with the prohibition against requiring students to pay fees, deposits, or other
<br />charges for participation in educational activities (5 CCR 4610).
<br />6. Retaliation against any complainant or other participant in the complaint process or anyone who has
<br />acted to uncover or report a violation subject to this policy.
<br />The Superintendent or designee at his/her discretion may keep a complainant's identity confidential, except to
<br />the extent necessary to investigate the complaint. The ROP will not investigate anonymous complaints unless it
<br />so desires. The ROP shall protect all complainants from retaliation. In investigating complaints, the confidentiality
<br />of the parties involved shall be protected as required by law. As appropriate for any complaint alleging retaliation
<br />or unlawful discrimination (such as discriminatory harassment, intimidation, or bullying), the Superintendent or
<br />designee shall keep confidential the identity of the complainant and/or the subject of the complaint if he/she is
<br />different from the complainant, as long as the integrity of the complaint process is maintained.
<br />When an allegation that is not subject to the Uniform Complaint Procedures is included in a Uniform Complaint
<br />Procedures complaint, the ROP shall refer the non -Uniform Complaint Procedures allegation to the appropriate
<br />staff or agency and shall investigate and, if appropriate, resolve the Uniform Complaint Procedures -related
<br />allegation(s) through the ROP's Uniform Complaint Procedures.
<br />The Superintendent or designee shall provide training to ROP staff to ensure awareness and knowledge of
<br />current law and related requirements, including the steps and timeliness specified in this policy and the
<br />accompanying administrative regulation.
<br />Student Grievance Procedure
<br />If a student believes his/her rights have been violated, he/she should use the following procedures:
<br />Step 1 — Informal Process
<br />Contact the ROP instructional administrator (see below). If unresolved, then file a complaint (see Step 2).
<br />Step 2 — Formal Process
<br />Send a written complaint to the Assistant Superintendent, Educational Services at 385 N. Muller
