3.5.2.3 The contractor shall not dispose of hazardous material on the site. All such <br /> hazardous materials collected on the site shall be appropriately stored <br /> temporarily, after that to be disposed of by Contractor at an approved <br /> disposal site, per California statutes. <br /> 3.5.3 Contractor, at its own risk, may store equipment and materials required for maintenance <br /> in said facility, providing the City has agreed to provide such facility. However, the <br /> Contractor must always use safety standards and handling procedures as applied to such <br /> equipment and materials. This contract assumes minimal facilities for the Contractors' <br /> vehicles and equipment. <br /> 3.5.3.1 City shall not be liable for damage or loss to Contractor's equipment, <br /> materials, and/or personal property. The contractor shall hold City harmless <br /> and waive any claims for damage for loss of use of any equipment, materials <br /> and/or property that may occur at City facilities. <br /> 3.5.4 Contractor shall maintain the service yard and/or storage area(s) in a clean, weed-free, <br /> well-organized manner in keeping with the highly visible nature of the surrounding area. <br /> Failure to do so may result in the Contractor's loss of the use of the storage area(s). <br /> 3.5.4.1 The service yard and/or storage area(s) occupied by Contractor shall be <br /> cleaned and swept once per week and the sweepings disposed of in a lawful <br /> manner. <br /> 3.5.4.2 Contractor shall remove all undesirable material including, but not limited to, <br /> trash, accumulated debris, and equipment that is no longer usable for the <br /> purpose it was intended for, from the service yard and/or storage area(s). <br /> 3.5.5 The City may inspect service yard and/or storage area(s)for compliance anytime at City's <br /> discretion. <br /> 3.5.6 Upon expiration or termination of Contract, Contractor shall restore service yard and/or <br /> storage area(s) to its original condition. Nothing contained herein which permits <br /> Contractor to use designated space shall be deemed or construed as a lease of space, <br /> but shall be a mere right to use. <br /> 3.6 Utilities <br /> The City shall pay for the installation and use of all utilities at these sites, with the exception of the Contractor's <br /> telephone hookup and service. <br /> 3.7 Traffic Control <br /> 3.7.1 When working in road rights-of-way, Contractor shall comply with all procedures and <br /> requirements specified in the State of California (CALTRANS) Manual of Traffic Controls <br /> for Construction and Maintenance Work Zones and within the confines of applicable <br /> OSHA requirements. <br /> 3.7.2 Contractor shall cooperate with the Santa Ana Police Department (SAPD) relative to <br /> handling traffic through the area and shall make its own arrangements relative to keeping <br /> the working area clear of vehicles. If required, the contractor shall obtain an <br /> encroachment permit for any partial or complete lane closure. All work that requires traffic <br />
