<br /> 3. That the public interest and necessity require and
<br /> it is hereby ordered that the work and improvements on
<br /> Santa Ana Boulevard, from Main Street to Chapman Avenue,
<br /> which includes those portions thereof which are to be
<br /> acquired under these proceedings, together with the
<br /> necessary parcels of land for slope easements, and revet-
<br /> ment work to protect the improvements upon Santa Ana
<br /> Boulevard, where the same crosses Santiago Creek, which
<br /> parceis of land are also to be acquired under these pro-
<br /> ceedings; upon Broadway from Santa Clara Avenue to Santa
<br /> Ana Boulevard; and on portions of Charlotte Street, Roe
<br /> Drive, Main Street, Chapman Avenue, ~lower Street and
<br /> Riverside Drive, all as particularly set forth and des-
<br /> cribed in said Resolution of Intention No. 2142, and in
<br /> the specifications, plans, profiles and detailed drawings
<br /> therein referred to, be made and done.
<br /> 4. That the boundaries of the Assessment District and
<br /> the grades to which said improvements are to be construc-
<br /> ted shall be those set forth in said Resolution of Inten-
<br /> tion No. 2142, and in the specifications therein referred
<br /> to, reference to which is hereby made.
<br /> 5. That the City Attorney of the City of Santa Ana is
<br /> hereby ordered to bring an action in the name of the City
<br /> of Santa Ana in the Superior Court of the State of Cali-
<br /> fornia, in and for the County of Orange, for the condem-
<br /> nation of the property necessary to be taken for the
<br /> acquisition herein ordered, and described in Section 1
<br /> of said Resolution of Intention No. 2142, and to do all
<br /> things necessary to prosecute said action to final
<br /> determination.
<br /> 6. That the public interest and convenience require
<br /> and it is hereby ordered that the City of Santa Ana,
<br /> plaintiff in the said condemnation action, take immediate
<br /> possession and use of the property herein ordered to be
<br /> acquired, upon complying with the requirements of law
<br /> applicable thereto, and that the said City Attorney re-
<br /> port to this City Council the amounts of money required
<br /> therefor as soon as the s m me can be ascertained.
<br /> 7. That the time hereby fixed for receiving bids for
<br /> the doing of said work and improvements herein ordered is
<br /> the 16th day of December, 1929, at the hour of 7:30
<br /> o~clock P.M., and the Clerk of this City Council is here~
<br /> ordered to post and to publish in the newspaper designate~
<br /> in said Resolution of Intention No. 2142, a notice invit-
<br /> ing sealed bids, requiring in such notice that all bids
<br /> shall be accompanied by a certified check or bond, all as
<br /> required by the provisions of Section 12, of the "Acqui-
<br /> sition and Improvement of 1925", as amended.
<br /> 8. That to defray the expenses of the acquisitions,
<br /> work and improvements herein ordered, bonds will be issue
<br /> to the total amount of the same, said bonds to bear in-
<br /> terest at the rate of six percent per ann,~n (except as
<br /> herein stated, for acquisition and immediate possession
<br /> bonds) payable semi-annually, the first interest payment
<br /> to be made on the Snd day of January, or the 2nd day of
<br /> July (whichever month first succeeds the date of the bond
<br /> next succeeding one year after the date of such bonds, and
<br /> the aggregate principal of all bonds issued under these
<br />proceedings to be paid and discharged within twenty-three
<br /> years after the date of is~uance, approximately one-
<br /> twentieth part of suchaggregate principal to be paid
<br /> annually, sll in gold coin, and that a special furn for
<br /> the payment of said bonds will be constituted by the levy
<br /> of special assessment taxes upon the land within the
<br /> Assessment District (excepting the land owned by the City
<br /> of Santa Ana, Santa Aha Board of Education and the County
<br /> of Orange, @nd in use in the performance of s public func-
<br /> tion) inaccordance with the provisions of the"~cquisitio~
<br /> and Improvement Act of 1925", and amen~nents thereto,
<br /> according to the assessed value of said lands, exclusive
<br /> of the imPrOvements thereon, except as otherwise in said
<br /> act provided. That ~e first payment on the aggregate
<br /> principal of the bonds issued will be made three years
<br /> after the issuance thereof.
<br /> That the interest rate to be paid on all acquisition
<br />bonds and immediate possession bonds, if any, which shall
<br />be issued under these proceedings, shall be issued at a
<br />maximum rate which shall not exceed eight percent per
<br />annum, payable semi-annually, the exact rate of interest
<br />at which such bonds are to be issued and sold to be deter-
<br />mined at the sale of such acquisition, or i~medtate
<br />possession bonds.
<br /> 9. That tho proceedings for said acquisition, work and~.
<br />improvements shall be had and taken under and in accordan~
<br />with an Act of the Legislature of the State of California,
<br />known and designated as the "Acquisition and Improvement
<br />Act of 1925", approved May 23, 1925, and amendments there-
<br />to, and said bonds shall also be issued in accordance wit~
<br />the provisions of said act.
<br /> The foregoing Resolution was duly and regularly passed
<br />and adopted by the affirmative vote of all five members o~
<br />the City Council of the City of Santa Ana, at an adjourned
<br />regular meetim~ thereof, held on the 25th day of November,
<br />1929, by the following vote, to-wit:
