136 <br /> <br />part of the Minutes a~follows: <br /> <br /> 'Your committee appointed to investigate the report that <br />the property lying adjacent to and fronting upon Santa Aha <br />Boulevard was always to remain in a Single Family ResidenCe <br />District, reports as follows: <br /> That the cost of the improvement of Santa Aha Boulevard was <br />approximately $297,000.00. That out of said cost of the total <br />improvement, the right of way.for said Santa Ana Boulevard <br />cost approximately $%3,000.00, that in order to persuade and <br />induce the property owners residing in said district to vote <br />in favor of the annexation of said strip and the opening of <br />said right-of-way that a meeting was held of the property <br />owners in said district along which said right of way was <br />opened, at which time all of the then members of the City <br />Council including Councilmen Purington, Kelly, Goode and <br />McBride were present at the home of James Smiley, with the <br />said residents in said district, and that at said time the <br />said property owners were advised that when said property <br />became annexed to the City of Santa Aha that it would be <br />automatically in the Single Family Residence District, and <br />the same members of the Council pledged their word that they <br />would not allow said property to be devoted to anything other <br />than Single Family Residence purposes; <br /> That your committee is advised that relying upon said pro- <br />mises the said property owners voted to annex said property <br />to the City and to permit the opening of said Santa Aha <br />Boulevard; that your committee feels that ~he changing of any <br />portion of said property from Single Family Residence Dis- <br />trict to such use or business purposes is a breach of good <br />faith with such property owners and citizens and therefore I <br />recommend that no permits f~r special use or business use be <br />granted upon the property fronting upon said Santa Ana Boule- <br />yard. <br /> Respectfully submitted, <br /> <br />(Signed) P. Kester. <br /> <br />the recommendation of the Planning Commission was accepted <br />and the application of W. C. Kester was denied to erect a <br /> <br />twelve unit auto court immediately east of the $ilmore 0il <br /> <br />Company's distributing plant fronting Santa Ana Boulevard. <br /> <br />In Re <br /> <br />On motion of Trustee Bruns, seconded by Penn and carried, the <br /> <br />Parking Stalls <br /> <br />City Engineer and Street Commissioner were appointed as a com. <br /> <br />on N. Broadway. <br /> <br />mittee to confer with the Board of Supervisors and Engineer <br /> on the West side of B~ <br />relative to closing curbing in front of the Court House Annex <br /> <br />to permit more parking space. <br /> <br />The motion of Trustee Layton to adopt the following Resolu- <br /> <br />ResolUtion to <br /> <br />tion: <br /> <br />Acquire Property for Parks. "AResolution of the City Council of the City of <br /> Santa Ana submitting to the electors of said City <br /> an Ordinance declaring that public necessity and <br /> convenience require the acquisition of certain <br /> real property for public purposes" <br /> Amended--See Minutes ............................................ / <br /> October 18th, 1937. was duly seconded by Trustee Bruns to brlng the matter up for <br /> <br />discussion. <br /> <br />The motion of Trustee Smith to postpone consideration of this <br /> <br />Resolution indefinitely, was lost for lack of a second. <br /> <br />The motion to adoptthe the Resolution was lost By the follow- <br /> <br />lng vote: <br /> <br />A~es, Trustees Ernest H. Layton, Fred C. Rowland. <br /> <br />Noes, Trustees Plummet W. Bruns, Joseph P. Smith, W. H. Penz <br /> <br />Absent, Trustees None. <br /> <br />On motion of Trustee Layton, seconded by Bruns and carried, <br /> <br />the City Council adjourned. <br /> <br /> <br />
