No. 4022 <br />Appoint special <br />counsel <br /> <br />and for site acquisition and rights-of-way $10,?07.36 for post-war <br /> <br />public works program, was received and filed. <br /> <br />On motion of Trustee Martin, seconded by Reed and carried, the <br /> <br />following Resolution entitled: <br /> <br />"Resolution concerning submission of request <br />for site acquisition aid to the post-war <br />public works review board for Statets share <br />of cost of such acquisition" <br /> <br />was read, considered, designated Resolution No. 4021 and passed by <br /> <br />the following vote: <br /> <br /> Ayes, Trustees <br /> <br /> Noes, Trustees <br /> Absent, T~ustees <br /># <br /> <br />W.J.Oheney, John W. Martin Jr., <br />Virgil H. Reed, Allen A. Mandy. <br />Courtney R. Chandler. <br />None <br /> <br />On motion of Trustee Chandler, seconded by Cheney and carried, the <br />recommendation of the Recreation Commission was approved and <br />Lawrence Patterson and Eenneth E. Morrison were reappointed for <br />four year terms$ terms to expire December 2, 1954. <br /> <br />Communication was read from Miss A.L.D~rha~, 1327 Maple Street <br />reference assessment for weed cleaning and on motion of Trustee <br />Martin, seconded by Cheney and carried, matter was referred to <br /> <br /> the City Engineer to report back at the next meeting. <br /> # <br /> <br />On motion of T~ustee Reed, seconded by Martin and carried, <br />communications from ~T.Woodwar~ requesting certain lnfo~mation <br />reference proposal of Paul M. Johnson for collection of trash and <br />garbage, were received and filed. <br /> <br />Communication was read from City Attorney setting forth reasons <br />why he did not wish to represent the City as legal counsel and <br />stating that if the Council cares to defend the suit filed by <br />Thcs. E. Davis reference contract with Paul M. Johnson for colleo~ <br />ion of trash and garbage, special counsel may be employed. On <br />motion of Trustee Reed, seconded by Martin and carried, communicat: <br /> <br />was received and filed. <br />. <br />On motion of TrusteeReed, seconded by Martin and o~rried, the <br />following Resolutio~ entitled~ <br /> <br /> "Resolution Appointing Special Counsel" <br /> <br />to defend the City in suit filed by Thcs. E. Davis in connection <br />with contract with Paul N. Johnson for collection of trash and <br />garbage was read, considered, designated Resolution N~.4022 and <br />passed by the following vote: Before roll call *as taken <br />Trustee Chandler requested that his statement be included in the <br />record; as f~llows: "This Council granted me permission to leave <br />the State and I was not present at either Council meeting when <br />action was taken regarding the trash and garbage contract with the <br />Johnsons. I have not had any part in this matter, Whatever, but <br />there is now a lawsuit to determine whether this contract ia <br />illegal, or not, and I do not believe any public funds should be <br />spent on this in any way until the legality of the Whole transact' <br />ion is decided by the Court. For that reason, I am against <br />employing an Attorney at the taxpayers~ expense and vote #no" on <br />the Resolution to do so.# <br /> <br />on <br /> <br /> <br />
