No. 4022 Appoint special counsel and for site acquisition and rights-of-way $10,?07.36 for post-war public works program, was received and filed. On motion of Trustee Martin, seconded by Reed and carried, the following Resolution entitled: "Resolution concerning submission of request for site acquisition aid to the post-war public works review board for Statets share of cost of such acquisition" was read, considered, designated Resolution No. 4021 and passed by the following vote: Ayes, Trustees Noes, Trustees Absent, T~ustees # W.J.Oheney, John W. Martin Jr., Virgil H. Reed, Allen A. Mandy. Courtney R. Chandler. None On motion of Trustee Chandler, seconded by Cheney and carried, the recommendation of the Recreation Commission was approved and Lawrence Patterson and Eenneth E. Morrison were reappointed for four year terms$ terms to expire December 2, 1954. Communication was read from Miss A.L.D~rha~, 1327 Maple Street reference assessment for weed cleaning and on motion of Trustee Martin, seconded by Cheney and carried, matter was referred to the City Engineer to report back at the next meeting. # On motion of T~ustee Reed, seconded by Martin and carried, communications from ~T.Woodwar~ requesting certain lnfo~mation reference proposal of Paul M. Johnson for collection of trash and garbage, were received and filed. Communication was read from City Attorney setting forth reasons why he did not wish to represent the City as legal counsel and stating that if the Council cares to defend the suit filed by Thcs. E. Davis reference contract with Paul M. Johnson for colleo~ ion of trash and garbage, special counsel may be employed. On motion of Trustee Reed, seconded by Martin and carried, communicat: was received and filed. . On motion of TrusteeReed, seconded by Martin and o~rried, the following Resolutio~ entitled~ "Resolution Appointing Special Counsel" to defend the City in suit filed by Thcs. E. Davis in connection with contract with Paul N. Johnson for collection of trash and garbage was read, considered, designated Resolution N~.4022 and passed by the following vote: Before roll call *as taken Trustee Chandler requested that his statement be included in the record; as f~llows: "This Council granted me permission to leave the State and I was not present at either Council meeting when action was taken regarding the trash and garbage contract with the Johnsons. I have not had any part in this matter, Whatever, but there is now a lawsuit to determine whether this contract ia illegal, or not, and I do not believe any public funds should be spent on this in any way until the legality of the Whole transact' ion is decided by the Court. For that reason, I am against employing an Attorney at the taxpayers~ expense and vote #no" on the Resolution to do so.# on
