Vegely <br /> (SEAL) City Clerk. <br /> <br />RESOLUTION NO. lOVS. <br /> <br /> · HEHE~S, The Board of Trustees of the City of Santa <br />Aha, did on the 28th day of August, 192~, award the contract <br />for the ensuing year's advertising to the Register Publishing <br />Company as the lowest responsible bidder therefor, pursuant <br />to its bid for publishing said city advertising; and <br /> <br /> WHEREAS, formal contract has not yet been made with <br />said Register Publishing Company; and <br /> <br /> WHEREAS, the validity of said award has been ques- <br />tioned by suit brought by an unsuccessful bidder and said <br />Board of Trustees l~eve been advised that the said award might <br />be held invalid; and <br /> <br /> WHEREAS, there are now pending various and sundry <br />legal proceedlugs relative to the improvements of the City of <br />Santa Aha, requiring the publication of certain legal adver- <br />tisements; and <br /> <br /> WHEHEAS, the validity of such proceedings might <br />hereafter be questioned, should the award of said contract be <br />adjudged legally insufficient; and <br /> <br /> WHEREAS, doubt has arisen as to the power, authori- <br />ty and Jurisdiction of the Board of Trustees to award any con- <br />tract for city advertising without re-advertising and calling <br />for bids; <br /> <br /> <br />
