city commonly known as Benton Way from a radial line extended across Benton Way from a point of curve 126.46 ft. southerly from the northeast corner of Lot 152, of sa~d Tract No. 425 to the south line of Riverside Drive; also a portion of that open public street in s~d city commonly known as Heliotrope Drive from the west line of Benton Way to the south line of said Tract No. 425, excepting that portion within the inter- section of North P~rk Blvd. I hereby certify the foregoing Resolution was regu- lsrly introduced before and passed by the Board of Trustees of the City of Santa Ana at an adjourned regular meeting ther~ of held ou the 18th day of September, 1923, by the following vote: Ayes: Trustees, C. RESOLUTION NO. lOVS. · HEHE~S, The Board of Trustees of the City of Santa Aha, did on the 28th day of August, 192~, award the contract for the ensuing year's advertising to the Register Publishing Company as the lowest responsible bidder therefor, pursuant to its bid for publishing said city advertising; and WHEREAS, formal contract has not yet been made with said Register Publishing Company; and WHEREAS, the validity of said award has been ques- tioned by suit brought by an unsuccessful bidder and said Board of Trustees l~eve been advised that the said award might be held invalid; and WHEREAS, there are now pending various and sundry legal proceedlugs relative to the improvements of the City of Santa Aha, requiring the publication of certain legal adver- tisements; and WHEHEAS, the validity of such proceedings might hereafter be questioned, should the award of said contract be adjudged legally insufficient; and WHEREAS, doubt has arisen as to the power, authori- ty and Jurisdiction of the Board of Trustees to award any con- tract for city advertising without re-advertising and calling for bids;
