RESOLUTION NO. 2(151. <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA <br /> ANA, CALIFORNIA, RELATING TO THE ISSUANCE OF STREET <br /> IMPROVEMENT BONDS PURSUANT TO RESOLUTION OF INTENTION <br /> NO. 193§; DETERMINING THE AMOUNT OF IR~PAID ASSESSMENT; <br /> PRESCRIBING THE DENOMINATION OF SUCH BONDS AND PROVIDING <br /> FOR THEIR ISSUANCE IN ANNUAL SERIES: <br /> <br /> WHEREAS, pursuant to statute, notice of the filing of list of unpaid <br />assessments was duly given in the manner and form required by law, that the warran~ <br />assessment and diagram was recorded on the 18th day of September, 1928, for the <br />work and improvement made by Gritton and Stephenson, under that certain contract <br />awarded to them on the llth day of June, 1928, upon portions of Shelton Street, <br />Baker Street, First Street and Second Street, as set forth in Resolution of <br />Intention No. 195~; and that sai'd warrant, assessment and diagram were returned to <br />the Street Superintendent'of said City, together with a w~itten statement of all <br />payments received upon the said assessment; and after the full expiration of <br />thixWcy (50) days after the recording of said warrant, the said Street Superintend- <br />ent duly made and filed with the City Clerk of said City of Santa And, a complete <br />list of all assessments unpaid upon the said assessment, which list is now on <br />file in the office of the City Clerk of said City; now upon evidence shown, this <br />City Council determines that the assessments therein mentioned were then unpaid, <br />the total aggregate thereof being the sum of Thirty-nine Hundred Sixty-eight and <br />V1/iO0 Dollars ($~968.V1), and that there has been paid since the filing of the <br />list of unpaid assessments by the Street Superintendent the following assessment, <br />to-wit: Assessment No. 38 for $2.?3, and that there now remains unpaid the sum of <br />Thirty-nine Hundred Sixty-five and 98/100 Dollars ($~96~.98) upon the assessments <br />shown upon said list. <br /> <br /> Reference is hereby made to Resolution of Intention No. 1935 of the <br />City Council of the City of Santa Aha, passed on the ?th day of May, 1928, for a <br />complete description of the work herein mentioned, and to the list of unpaid <br />assessments ~l~ed as above stated for-the assessments unpaid; and <br /> <br /> WHEREAS, interested persons were notified in the manner required by law <br />to appear before the City Council in the Council Chamber of the City Hall of said <br />City at the hour of ?:30 o'clock P.M. on Monday, the 29th day of October, 1928, <br />and show cause why bonds should not be issued upon the security of the unpaid <br />assessments shown on the Street Superintendentts list; and <br /> <br /> WHEREAS, notice was duly given in the manner and form required by law, <br />that serial bonds to represent unpaid assessments, bearing interest at the rate of <br />six per cent per annum, will be issued hereunder in the manner p~ovided in the <br />"Improvement Bond Act of 1916", the last installment cf which bonds shall mature <br />nine years fr~m the 9.nd day of July, next succeeding ten (10) months f~om their <br />date, and all interested persons having ap~ ared before this City Council and <br />having been given a full opportunity to show cause why b~ds should not be <br />issued upon the security of the unpaid assessments shown on said list, and all <br />objections presented having been heard and Considered. <br /> <br /> IT IS THEREF~E NOW BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, <br />DETERMINED, RESOLVED AND ORDERED AS FOLLOWS: ~hat no cause has been shown why <br />bonds should not be issued upon the secumity of said unpaid assessments, and does <br />hereby overrule all objections thereto, and does hereby direct the issuance of <br /> <br /> <br />
