<br />IN THE MATTER OF ACQUISITION AND IMPROVEMENT DISTRICT

<br />RESOLUTION OF INTENTION NO. 2~60
<br />
<br /> The City Council of the City of Santa Ana, pursuant to the provisions
<br />of the Acquisition and Improvement Act of 1925, as amended, do resolve as follows:
<br />
<br /> Section 1. That the public interest and necessity require and it is
<br />the intention of the City Council of the City of Santa Ara, California, to order
<br />the following improvements made and work done, to-wit:
<br />
<br /> That a partial separation of grades be made on East Fourth Street betweez
<br />Poinsettia Street and Santa Fe Street, am said two last named streets exist
<br />northerly from Fourth Street, by the construction of an Underpass under the
<br />Atchison, Topeka and Santa Fe Railway Companyts and the Southern Pacific Railroad
<br />Company's railroad tracks, respectively, said Underpass to be approximately
<br />feet long and being 27 feet between sidewalls, with aminimum clearance of 12 feet~
<br />and shall be equipped with all necessary lights, drainage facilities, railroad and
<br />street brid~i~g, and all ~ther necessary appurtenances thereto; and the constructic
<br />of surface pavement, sidewalks, curbs, culverts, driveways, relocation of
<br />Ornamental Street Lights, sanitary sewers, stoEn drains and all other necessary
<br />appurtenances thereto, necessary to accomplish said purpose.

<br /> Also the improvement of Santa Fe Street between First Street and Fourth
<br />Street by the constr~ction of a concrete pipe stoEn drain thereon, together with
<br />all necessary appurtenances thereto, necessary to accomplish said partial
<br />separation of grades on East Fourth Street as aforesaid.
<br />
<br /> Excepting however from the above described streets any portions thereof
<br />which are already improved to the official grade, as shown on the plans.
<br />
<br /> That the work to be done as herein set forth shall include the furnish-
<br />lng of all labor, equipment and materials necessary for or appurtenant to the con-
<br />struction and completion of all work herein specified.
<br />
<br /> Reference is hereby made to the specifications, plans, profiles and
<br />detailed drawings for the above described worked!improvement, approved by said
<br />City Council of the City of Santa Ara, and on file 'in the office of the Clerk of
<br />said City for a full and detailed description and location of said proposed work
<br />and improvement, and of the grades to which the same is to be constructed,
<br />together with a statement of the estimated costs of the improvement, inclusive of
<br />the incidental expel~ses and costs of the proceedings; and notice of all persons
<br />affected is directed to the grades for the proposed improvements, and to the
<br />provisions of the Acquisition and Improvement Act of 1925, as amended, relating to
<br />grades. Particular notice is directed to the fact that substantial changes in
<br />the relation of the elevation of abutting property to that of said publiz ways as
<br />they will exist after being improved will result from the construction of the
<br />abbwe mentioned improvements to the proposed grades.
<br />
<br /> That for the installation and construction of the hereinbefore described
<br />work and improvements certain patented articles will be used, and license
<br />agreements between the owners or ~elling agents for said articles and the City of
<br />Santa Ara, are now on file in the office of the City Clerk, to which said agreement
<br />reference is hereby made, and the same is made a part of this Resolution by refer-
<br />ence the same as though set forth in full herein.
<br />
<br /> Section 2. That the district of lands which will be benefited by said
<br />proposed work and improvements to be known as the "Assessment District" shall be
<br />proposed include all that territory in the said City of Santa Ana, County of Orange
<br />State of C~lifornia, within the following described exterior boundary lines, to-wit
<br />
<br /> Beginning at the Southwesterly corner of Lot 5, Block 15, Original
<br />Town of Santa Ara, as per map thereof recorded in Miscellaneous Records,
<br />Book 2, Page 51, Records of Los Angeles County; thence Northerly along
<br />the Westerly line of Lots 5, 8 and 9 of said Block 15 to the Northwesterly
<br />corner of Lot 9, said Block 15; thence Northerly in a direct line to the
<br />Southwesterly corner of Lot l, Block 18 of Original Town of Santa Ana;
<br />thence Northerly along the Westerly line of Lots l, 4 and 5 of said Block
<br />18, a distance of 125 feet to a point; thence Easterly along a line drawn
<br />parallel to and distant 125 feet NorthePly from the Northerly line of
<br />Fifth Street to an intersection with the Northeasterly line of Block "~",
<br />Burgess Addition, as per map thereof recorded in Miscellaneous Records,
<br />Book 13, Page 33, Records of Los Angeles County; thence Southeasterly
<br />along the said Northeasterly line of said Block D , t~ an intersection
<br />with the Easterly line of Lot 3 of said Block "D"; thence Southerly in a
<br />direct line to a point in the Northerly line of Fourth Street distant
<br />feet Easterly from the Easterly line of Poinsettia Street, said point
<br />being also the Southeasterly corner of Lot 5 of Block B of said Burgess
<br />Addition; thence Easterly along the Northerly line of Fourth Street to a
<br />point distant 290 feet Westerly from the Westerly line of Tract No. 344
<br />as per Map thereof recorded in Book 15, Page 5, Miscellaneous Maps,
<br />Records of Orange County; thence Northerly along a line drawn parallel to
<br />and distant 290 feet Westerly from the Westerly line of said Tract No. 344,
<br />a distance of 98.40 feet to a point; thence Easterly in a direct line to
<br />the Northwesterly cor~er of LOt l, Block C, said Tract'No. 344; thence
<br />Easterly along the Northerly ~ine of said Lot l, Block C, to the North-
<br />easterly corner of said Lot l, thence Easterly in a direct line to the
<br />Northwesterly corner of LOt l, Block "D" of said Tract No. 344; thence
<br />Easterly along the Northerly line of Lots I and 8 of said Block "D", to
<br />the Westerly line of Grand Avenue; thence Easterly in a direct line to a
