RESOLUTION NO. 2263 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY 0F <br /> SANTA ANA, CALIFORNIA, RELATING TO THE ISSUANCE <br /> OF STREET IMPROVEMENT BONDS PURSUANT TO RESOLUTION <br /> OF INTENTION NO. 2199; DETERMINING THE AMOUNT 0F <br /> UNPAID ASSE2SMENTS; PRESCRIBING THE DENOMINATION OF <br /> SUCH BONDS AND PROVIDING FOR THEIR ISSUANCE IN <br /> ANNUAL SERIES. <br /> <br /> WHEREAS, pursuant to Statute, notice of filing list of unpaid assess- <br /> ments was duly given in the manner and form required by law, that the warrant, <br /> assessment and diagram was recorded on the 21st day of October, 1930, for the <br /> work and improvement made by Walker and Martin, under that certain contract <br /> awarded to them on the 30th day of June, 1930, upon Birch Street between Fairview <br /> Avenue and the Northerly line of Tract No. 352, as set forth in Resolution of <br /> Intention No. 2199; that said warrant, assessment and diagram were returned to the <br /> Street Superintendent of said City, together with a written statement of all pay- <br /> ments received upon the said assessment; and after the full expiration of thirty <br /> (30) days al%er the date of the recording of said warrant, the said Street <br /> Superintendent duly made and filed with the City Clerk of the said City of Santa <br /> Aha, a complete list of all assessments unpaid upon the said assessment, which <br /> list is now on file in the office of the City Clerk of said City; now upon <br /> evidence shown, this City Council determines that the assessments therein mention, <br /> were then unpaid, the total aggregate thereof being the sum of Sixteen Hundred <br /> Forty and 26/100 Dollars ($1,640.26), and that there have been paid since the <br /> filing of the list of unpaid assessments by the Street Superintendent the follow- <br /> ing assessments, to-wit: Assessment No. 40 for $48.25; and that there now remaim <br /> unpaid the sum of Fifteen Hundred'Ninety-two and 1/100 Dollars ($1,592.01) <br /> upon the assessments shown upon said list. <br /> <br /> Reference is hereby made to Resolution of Intention No. 2199 of the Cit <br /> Council of the City of Santa Aha, passed on the 26th day of May, 1930, for a <br /> complete description of the work herein mentioned, and to the list of unpaid <br /> assessments filed as above stated for the asses~ents unpaid; and <br /> <br /> WHEREAS, interested persons were notified in the manner required by law <br /> to appear before the City Council in the Council Chamber of the City Hall of said <br /> City at the hour of 7:30 o~clock P.M. on Monday, the 15th day of December, 1930, <br /> and show cause why bonds should not be issued upon the security of the unpaXd <br /> assessments shown on the Street Superintendent's list; and <br /> <br /> WHEREAS, notice was duly given in the manner and form required by law, <br />that serial bonds to represent unpaid assessments bearing interest at the rate of <br />six percent per annum will be issued hereunder in the mannsr provided in the <br />"Improvement Bond Act of 1915", the last installment of which bonds shall mature <br />nine years from the 2nd.day of July, next succeeding ten (10) months from their <br />date, and all interested persons having appeared before this City Council and <br />having been given a full opportunity to show cause why bonds should not be issued <br />upon the security of the unpaid assessments shown on said list, and all objections <br />presented having been heard and considered. <br /> <br /> IT IS THEREF~E NOW BY THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DETERMINED, RESOLVED AND ORDERED AS FOLLOWS: That no cause has been shown why <br />bonds should not be issued upon the security of said unpaid assessments, and does <br /> <br />d <br /> <br /> <br />
