CITY OF SANTA ANA <br />SPECIFICATIONS <br />PROJECT NO.: 25-6030 <br />TRAFFIC SIGNAL INSTALLATION AT SEGERSTROM AVENUE AND ROSEWOOD <br />AVENUE <br />SECTION 8 - FACILITIES FOR CITY PERSONNEL ........Not Used <br />SECTION 9 - CLAIMS RESOLUTION PROCEDURES <br />9-1 PUBLIC CONTRACT CODE SECTIONS 10240 AND 20104 <br />Public Contract Code Section 10240 and Public Contract Code Section 20104 are hereby <br />recognized and accepted as Reference General Provisions of these Specifications. <br />For purposes of the new law, "claim" means a separate demand by a contractor, sent by registered <br />or certified mail with return receipt requested, for one or more of the following: <br />• a time extension, including a claim for relief from damages or penalties for delay assessed <br />by a public entity. <br />• payment by the public entity of money or damages arising from work done by, or on behalf <br />of, the contractor pursuant to the contract for a public works project and payment for which <br />is not otherwise expressly provided or to which the claimant is not otherwise entitled. <br />• payment of an amount that is disputed by the public entity. <br />Upon receipt of a claim, the following steps apply: <br />• the public entity must conduct a reasonable review of the claim and provide a written <br />statement to the contractor within 45 days identifying what portion of the claim is disputed <br />and what portion is undisputed; this time period may be extended by mutual agreement of <br />the parties <br />• the claimant must furnish reasonable documentation to support the claim <br />• any payment due on an undisputed portion of the claim must be processed and made within <br />60 days after the public entity issues its written statement (amounts not timely paid bear <br />interest at 7% annually) <br />• public entity's failure to timely issue a written statement on the claim results in the claim <br />being deemed rejected in its entirety <br />• if claimant disputes the public entity's written response, or if the public entity fails to <br />respond to a claim within the time prescribed, the claimant may demand in writing an <br />informal conference to meet and confer <br />• upon receipt of such a demand, the public entity must schedule a meet and confer <br />conference within 30 days <br />20 <br />
