The City must report only <br />those days of unused sick leave that were accrued by the employee during the normal <br />course of employment. This section applies to members whose effective date of <br />retirement is within four (4) months of separation from employment. <br /> <br />12.5 <br /> <br />Military Service Credit as Public Service. Effective January 1, 2002, or as soon as <br />practicable thereafter, an employee covered by this Agreement may elect to purchase <br />up to four (4) years of service credit for any continuous active military or merchant <br />marine service prior to employment. The employee must contribute an amount equal <br />to the contribution for current and prior service that the employee and the employer <br />would have made with respect to that period of service. <br /> <br />12.6 <br /> <br />Retirement Reopener. Notwithstanding the provisions of Article XXIV, Waiver of <br />Bargaining During the Term of this Agreement, the City mad Union may reopen <br />Article XII Retirement, for the purpose of negotiating any new Supplemental or <br />Modified Retirement Formula for Local Miscellaneous Members that currently is not <br />available to contracting agencies. This Agreement to reopen negotiations for this <br />limited purpose shall begin only if the Union delivers to the City a written proposal <br />to negotiate for a new retirement formula within sixty (60) days of enactment of any <br />Supplemental or Modified Retirement Formula for Local Miscellaneous Members. <br />Failure to submit a written proposal to commence negotiations during the specified <br />period will result in negotiations being closed during the term of this Agreement. <br /> <br />If negotiations on a new Supplemental or Modified Retirement Formula for Local <br />Miscellaneous Members are successfully completed, the City will proceed to amend <br />its contract with the California Public Employees Retirement System (CalPERS) as <br />soon as practicable. If no agreement is reached by July 1 of the subsequent fiscal <br />year following enactment of the legislation, negotiations will cease and the City will <br />not be required to negotiate further during the term of this Agreement. <br /> <br />48 <br /> <br /> <br />
