including, but not by way of limitations, workers' compensation <br />claims, resulting from or arising out of the negligent acts, errors, or <br />omissions, arising out of the intentional or malicious acts of the <br />Union's representatives. <br /> <br />11. <br /> <br />The Union and the City of Santa Ana agree that the Union <br />President will not be required to carry out any City duties during the <br />time the Union President is on President's leave twenty (20) hours per <br />week. The Union President will be required to comply with the rules <br />and regulations of the City of Santa Ana as they apply to off-duty <br />employees, except such Union President will not be required to report <br />for any purpose during the four (4) hours per day or twenty (20) hours <br />per week of Union President's leave time. <br /> <br />12. <br /> <br />Upon return to duty from President's Leave of four (4) hours per <br />day, the Union President shall be restored to the same position <br />without loss of any benefits as he or she would have occupied or <br />accrued if there had been no disruption in duty status. For the <br />purpose of providing payment for Union President's Leave time and <br />for Union Business Leave time the City and the Union agree to the <br />creation of the following compensation time bank: <br /> <br />Any member of the Union who has a compensatory time <br />balance, vacation time or accrued in lieu holiday balance of <br />at least two (2) hours or more can voluntarily designate, in <br />writing, that he or she will contribute the value of such time <br />to a bank to be used to pay for President's Leave time and/or <br />Union Business Leave time. In addition, floating holiday pay <br />may also be contributed, but only in increments of eight (8) <br />hours. Such bank shall be for the purposes and subject to the <br />restrictions provided herein. <br /> <br />The employees' vacation leave, compensatory time and/or <br />accrued or unused holiday pay balance will then be reduced <br />by the amount of hours transferred to the bank. <br /> <br />Vacation leave time, compensatory time and/or accrued <br />floating or in lieu holiday time, together with the cost of <br />benefits shall be converted to its dollar value at the rate of pay <br />of the employee from whom the leave was received. Those <br />dollars (with benefit cost) shall be placed in the Union <br />Business Leave Bank.
