Business Leave, dollars will be withdrawn from such Union <br />Business Leave Bank, equal to the hourly rate (with benefit <br />cost) of the employee utilizing the leave multiplied by the <br />number of hours of leave taken. Withdrawal requests from <br />the bank will be for the purpose of conducting Union <br />business, which may include grievance investigation, <br />executive meetings, board of director meetings, training and <br />conventions sponsored by the Union, attendance at grievances <br />and Personnel Board hearings as witness for the Union, <br />President's Leave and other Union purposes as may be <br />determined by the President of the Union. Request for <br />withdrawal from the Bank shall be made only by the <br />President or designee to the Executive Director of Personnel <br />Services on forms mutually agreed to by the parties and <br />furnished by the City. The Union President's Leave or Union <br />Business Leave slip shall be presented to the Executive <br />Director of Personnel Services by the Union for withdrawal <br />from the bank. All vacation leave, compensatory time and <br />accrued floating or in lieu holidays transferred to the bank are <br />final transfers and shall not be recoverable for re-credit to any <br />individual employee's vacation leave account, compensatory <br />time account, or accrued holiday time account. <br /> <br />Release of employees for Union Business Leave shall be on <br />the same basis as employees are released from duty for <br />vacation leave, except that such requests for leave shall not <br />unreasonably interfere with the operation of the City <br />department and shall be approved by the employee's <br />Department Head. The employee taking Union Business <br />Leave shall not unreasonably interfere with the operation of <br />the City department and shall be approved by the employee's <br />Department Head. The Department Head shall not <br />unreasonably withhold permission to utilize President's Leave <br />time and/or Union Business Leave from any employee who <br />has been duly authorized by the Union to take such leave. <br /> <br />No withdrawal from or use of such bank may be made by or <br />on behalf of an employee ordered to take time offwithout pay <br />for disciplinary reasons. No withdrawal or use of such bank <br />may be made by or on behalf of any employee to be used for <br />purposes that are unlawful under the laws of the United <br />States, State of California or the ordinances of the City of <br />Santa Ana. <br /> <br />59 <br /> <br /> <br />
