Councilman Ward's motion to approve the City Manager's recom- <br />mendation set forth as Exhibit "A" in his memo dated October <br />31, to add item "E", Downtown Business Assistance Rehabilita- <br />tion, for an amount equal to 20 percent of the $12,000,000 <br />total funds available over a six-year period; and to add item <br />"F", Housing Assistance, in any of the designated areas, Down- <br />town West of the River and Delhi, for an amount equal to 20 <br />percent of the total funds for the six-year period, was <br />seconded by Councilman Yamamoto. <br /> <br />Following further deliberation by Council, Councilman Ward <br />withdrew the previous motion, with the consent of the second. <br /> <br />Councilman Ward's motion to approve the guideline proposals <br />set forth on Exhibit "A", subject addition of 10 percent of <br />the total available funds for the six-year period to be <br />designated for downtown business assistance, was seconded <br />by Councilman Yamamoto and carried unanimously (6-0): <br /> <br />Council approved the proposed guidelines for selecting target <br />areas and authorized Staff to solicit proposals from a private <br />consulting firm to develop an application for federal com- <br />munity development funds and a first-phase, three-year <br />comprehensive community development plan at a cost not to <br />exceed $70,000, on motion of Councilman Griset, seconded by <br />Councilman Ward and unanimously carried (6-0). <br /> <br />Council instructed Staff to respond to the Human Relations <br />Chairman and the West Community Service Center Advisory Board <br />by advising them of the Council's action with regard to <br />employing a consultant and the fact that in the plan develop- <br />ment process, much community input will be necessarF, on motion <br />of Councilman Griset, seconded by Vice Mayor Evans and <br />unanimously carried. (CA 140.20) <br /> <br />PORNOGRAPHIC NEWSPAPER RACK The City Attorney pre- <br />ORDINANCE STATUS sented an oral report <br /> on newspaper racks, <br /> stating that the City <br />is seeking to institute a plan somewhat similar to Garden <br />Grove. He stated that a detailed list of criteria has been <br />sent to the Department of Public Works for report back to the <br />City Attorney concerning the efficacy and effectiveness of <br />such a program. The City Attorney further stated that it is a <br />lobbying process to encourage action by the State in the field <br />of local option. <br /> <br />Councilman Griset stated he favors a local ordinance establishing <br />a local standard definition of obscenity. Councilman Ward stated <br />we should work with other Orange County cities on this problem. <br /> <br />Councilman Yamamoto submitted a petition of 900 signatures to <br />the Clerk for the record from people who are against the exist- <br />ing news rack display of pornographic materials. <br /> <br />The following spoke against newspaper racks on City property: <br /> <br />Mr. Art Jacques, 1525 Portola Avenue, suggested that all racks <br />be restricted from public property and owners of newspaper <br />racks be obligated to deal with private property owners if <br />they want a rack at a certain location. <br /> <br />Mr. Billy C. Hall, Executive Director of City Center Association, <br />stated that merchants are required to maintain public sidewalks <br />and clean them, and even though they have purchased a business <br />license, they are not allowed to sell anything on the sidewalk. <br />He stated he sees no difference between a newspaper's being <br /> <br />CITY COUNCIL MINUTES 410 NOVEMBER 4, 1974 <br /> <br /> <br />
