A previous motion by Mayor Evans, seconded by Councilman <br />Brandt to approve and file the Negative Declaration and to direct <br />the City Attorney to prepare a resolution to approve Variance <br />Application 77-4 with a maximum of 40 children and 10 employees, <br />failed to carry on a 5:4 vote, with Councilmen Ward, Yamamoto, <br />Ortiz and Bricken dissenting. <br /> <br />Councilmen expressed their concerns regarding over-occupancy of <br />the buildings and insufficient parking for employees. CA 13.5a <br /> <br />PUBLIC HEARING Mayor Evans stated that <br />APPEAL NO. 376 - VA 77-11 his company (First American <br />2151 E. SANTA CLARA - CONTINUED Title Co.) has orders from <br /> both participants in this <br />hearing, and that he felt he must decline to hear the matter. He <br />left the Council Chambers. <br /> <br />Vice Mayor Ward announced that this was the time and place for <br />the public hearing of Negative Declaration and Appeal No. 376 <br />of Planning Commission denial of Variance Application 77-11 to <br />allow self-service gas pumps on an existing market site at 2151 <br />East Santa Clara in the CS District. <br /> <br />A request by the appellant's attorney, Sam Barnes, for continuance <br />to June 20, 1977 at 7:30 P.M., was granted on the unanimously <br />approved 7:0 motion of Councilman Yamamoto, seconded by Councilman <br />Garthe. CA 13.3 <br /> <br />Mayor Evans returned to the Council Chambers. <br /> <br />RECESS <br /> <br />At 9:35 P.M. Mayor Evans <br />declared a recess of the <br />meeting; at 9:45 P.M. the <br />meeting was reconvened. <br /> <br />PUBLIC HEARING Mayor Evans announced that <br />APPEAL NO. 377 - VA 77-14 this was the time and place <br />2201 EAST WELLINGTON for the public hearing of <br />REFERRED TO PLANNING COMMISSION Negative Declaration and <br /> Appeal No. 377 of the <br />Planning Commission approval of Variance Application 77-14 to <br />allow the construction of a senior citizen housing facility at <br />2201 East Wellington in the LP District. <br /> <br />Senior Planner William Daugherty stated that the application is <br />for 133 units of senior citizen housing units 400 feet east of <br />Tustin Avenue; that the offstreet parking is 89 spaces which <br />represents a waiver request of 62 parking spaces and that the 89 <br />spaces represent 2/3 space per unit. <br /> <br />Donald B. Christeson, President of Christeson Co., 2030 East <br />Fourth Street, stated that the reason he did not object at the <br />Planning Commission hearing was that he acquired the property <br />to the east of the proposed development apparently after the <br />tax'rolls were prepared last year, and he was not aware of the <br />Planning Commission hearing; that the Santa Ana Community Hospital <br />was moved to its new location in order to attract new medical <br />facilities; that it was hoped that the hospital investments would <br />be protected by professional and business facil'ities in the new <br />location; that the integrity of the zoning of the area is being <br />chall~nged by this variance request; that this is not a "marginal" <br />area, nor is there any question of hardship; that the area is <br />zoned for professional use and the proposed use is inconsistent; <br /> <br />CITY COUNCIL MINUTES 195 JUNE 6, 1977 <br /> <br /> <br />
