4.8 On -Site Manager. The Association shall designate at least one on -site manager <br />as a contact for the Project and may contract with an off -site manager. Either on or off site <br />managers shall be responsible for such duties as designated by the Board relating to the <br />provisions of this Declaration and the Bylaws. The Association shall inform the City of the <br />name, address and telephone number of the on and off -site manager and of any and all changes to <br />such information within ten (10) days of said change. <br />4.9. Obstructions and Alterations. Except as otherwise provided in this Declaration, <br />the Association shall be responsible for ensuring that there.shall be no obstruction of the <br />Common Improvement Areas, that nothing shall be kept or stored in the Common Improvement <br />Areas (except for designated storage areas); and that nothing shall be altered, constructed or <br />planted in or removed from the Common Improvement Areas without the prior written consent <br />of the Association. <br />4.14. Removal of Debris and Graffiti. The Association shall be responsible for <br />keeping or causing the keeping of the Common Improvement Areas free of rubbish, debris and <br />other unsightly or unsanitary materials. The Association shall remove graffiti from Common <br />Improvement Areas and Owner's Parcels and Buildings within five days of its creation. For any <br />buildings with paint colors that are not consistent with the colors identified in the Association's <br />Architectural Guidelines, the property owner shall provide matching paint to the Association or <br />the Association will attempt the best match within colors identified by the Association's <br />Architectural Guidelines. <br />4.11 Insurance. The Association shall take out and maintain throughout the term of <br />this Declaration a comprehensive general liability and property damage policy in a reasonable <br />and appropriate amount. The Association shall take out and maintain throughout the term of this <br />Declaration a policy insuring the officers and members of the Board against errors and <br />omissions. The Association shall tape out and maintain throughout the term of this Declaration a <br />fidelity bond of insurance for board members, officers, trustees, employees and volunteers <br />responsible for handling fiinds collected and held for the Association naming as insured the <br />Association for an amount sufficient to cover at least one -and -one-half times the Association's <br />estimated annual operating expenses and reserves. All policies of insurance obtained by the <br />Association shall be obtained from an insurance company qualified to do and doing business in <br />the State of California, and such policies may be obtained from one or more companies. <br />V. OWNER DUTIES <br />5.1 Leases Subject to Declaration. Each Owner shall enter into written leases with <br />each new tenant of a Unit, in a form which has been approved by the Association. Each such <br />lease shall provide that the terms of the lease shall be subject in all respects to the provisions of <br />EXHIBIT E. Page 12 of 24 <br />
