this Declaration and that any failure by the tenant to comply with the terms of this Declaration <br />shall be a default under the lease. <br />5.2 Tenancy Applications. All prospective tenants of Units in each Owner's <br />Building shall make application through the Owner, who shall follow a tenant screening method <br />approved by the Association. <br />5.3 General Maintenance Obligations. Each Owner shall have the affirmative <br />obligation to prevent conditions dangerous to the public health, safety and general welfare; or <br />constitute an unsightly appearance or otherwise detract from the aesthetic and property values of <br />neighboring properties, as determined by the Association, in accordance with the rules and <br />standards which are established by the Board. <br />5.4 Maintenance of Landscaping. Each Owner shall maintain the landscaping on <br />such Owner's Parcels that are not included in the Common Improvement Areas so as to be absent <br />of the following: <br />(a) Lawns with grasses in excess of six (6) inches in height. <br />(b) Untrimmed hedges. <br />(c) Trees, shrubbery, lawns and other plant life dying from lack of water or <br />other necessary maintenance. <br />(d) Trees and shrubbery grown uncontrolled without proper pruning. <br />(e) Vegetation so overgrown as to be likely to harbor rats or vermin. <br />(f) Dead, decayed or diseased trees, weeds and other vegetation. <br />(g) Inoperative irrigation system(s). <br />5.5 Maintenance of Yards, Courtyards and Parking. Each Owner shall maintain <br />yards, parking areas, and courtyards on such Owner's Parcels so as to be absent of the following: <br />(a) Broken or discarded furniture, appliances and other household equipment <br />stored in yard areas for periods exceeding one (1) week. <br />(b) Packing boxes, lumber, trash, dirt and other debris stored in yard areas <br />visible from public property or neighboring properties, for periods exceeding one (1) week. <br />(c) Laundry hanging from trees, shrubs, fences or other yard areas. <br />EXHIBIT E: Page 13 of 24 <br />
