MAXIMUM ASSISTANCE PERIOD [Notice PIH 2023-04 and FYI FAQs; <br />FR Notice 1/24/22] <br />Vouchers are limited by statute to a total of between 36 months and 60 months of housing <br />assistance. At the end of the statutory time period, assistance must be terminated. However, any <br />period of time for which no subsidy (HAP) is being paid on behalf of the youth does not count <br />toward the limitation. It is not permissible to reissue another FYI TPV to the same youth upon <br />expiration of their FYI assistance. <br />Participants do not “age out” of the program. A participant may continue with the program <br />until they have received the period of assistance for which they are eligible. Age limits are only <br />applied for entry into the program. <br />Extension of Assistance <br />FYI voucher holders who first leased or lease a unit after December 27, 2020, may be eligible for <br />an extension of assistance up to 24 months beyond the 36-month time limit (for a total of 60 <br />months of assistance). <br />While FYI voucher holders cannot be required to participate in the Family Self-Sufficiency <br />(FSS) program as a condition of receipt of assistance, an eligible youth who participates in the <br />FSS program and is in compliance with the applicable terms and conditions of the program is <br />entitled to receive assistance for up to an additional 24 months. A FYI voucher holders must <br />accept an FSS slot if it is offered to them prior to the 36-month mark in order to receive an <br />extension of assistance (unless the youth meets one of the statutory exceptions described below). <br />Statutory Exceptions <br />FYI voucher holders will be entitled to receive an extension of assistance for up to 24 months <br />beyond the 36-month time limit without participating in the PHA’s FSS program if they certify <br />that they meet one of the exceptions below: <br /> The FYI voucher holder is a parent or other household member responsible for the care of a <br />dependent child under the age of six or for the care of an incapacitated person. <br />SAHA Policy <br />SAHA defines incapacitated person per California Probate Code Section 1801 (a):An <br />incapacitated person is someone who, due to a physical or mental condition, lacks the <br />ability to provide for their own well-being or manage their finances. <br />SAHA will apply this exception in a manner that provides extensions of FYI assistance to <br />the broadest population possible consistent with the statutory requirements. <br />The FYI voucher holder will be required to self-certify that they meet this exception on a <br />SAHA-provided form. This certification is the only documentation that the FYI voucher <br />holder must submit. <br />The child or incapacitated person is not required to reside in the household in order for <br />the FYI voucher holder to certify they meet this exception. For example, a child in a joint <br />custody arrangement under the age of six who resides in the household only part time <br />may qualify the FYI voucher holder for this exception. <br />EXHIBIT 1
