CEQA Class 32 Exemption – 400 W Warner Ave <br />April 7, 2025 <br />Page 7 of 10 <br /> <br /> <br />a) Location. Classes 3, 4, 5, 6, and 11 are qualified by consideration of where the project is to be located – a <br />project that is ordinarily insignificant in its impact on the environment may in a particularly sensitive <br />environment be significant. Therefore, these classes are considered to apply all instances, except where <br />the project may impact on an environmental resource of hazardous or critical concern where designated, <br />precisely mapped, and officially adopted pursuant to law by federal, state, or local agencies. <br />b) Cumulative Impact. All exemptions for these classes are inapplicable when the cumulative impact of <br />successive projects of the same type in the same place, over time is significant. <br />c) Significant Effect. A categorical exemption shall not be used for an activity where there is a reasonable <br />possibility that the activity will have a significant effect on the environment due to unusual circumstances. <br />d) Scenic Highways. A categorical exemption shall not be used for a project which may result in damage to <br />scenic resources, including but not limited to, trees, historic buildings, rock outcroppings, or similar <br />resources, within a highway officially designated as a state scenic highway. This does not apply to <br />improvements which are required as mitigation by an adopted negative declaration or certified EIR. <br />e) Hazardous Waste Sites. A categorical exemption shall not be used for a project located on a site which is <br />included on any list compiled pursuant to Section 65962.5 of the Government Code. <br />f) Historical Resources. A categorical exemption shall not be used for a project which may cause a substantial <br />adverse change in the significance of a historical resource. <br /> <br />The applicability of the above-listed conditions to the 400 W Warner Ave Project is discussed below. <br /> <br />a) This Condition would not apply under a Class 32 exemption, as it only applies to Classes 3, 4, 5, 6, and 11. <br /> <br />b) As presented within this Memorandum, the Project would not result in any significant individual or <br />cumulative environmental impacts. As such, Condition b) is not applicable to the Project. <br /> <br />c) No significant effects would occur as a result of the Project. The Project proposes retrofitting of an existing <br />urban use within a developed area of the City. No unusual circumstances exist. As such, Condition c) is not <br />applicable to the Project. <br /> <br />d) According to the California Department of Transportation (Caltrans) California Scenic Highway Mapping <br />System, the nearest officially designated state scenic highway is a portion of California State Route 91 <br />located approximately 9.2 miles northeast of the Project site. This section of the scenic highway is not <br />visible from the Project site or surrounding areas.3 As such, the Project would not result in damage to <br />scenic resources within a highway officially designated as a state scenic highway; Condition d) is not <br />applicable. <br /> <br />e) Pursuant to Government Code Section 65962.5, the Hazardous Waste and Substances Sites (Cortese) List <br />is a planning document used by the State and local agencies to comply with the California Environmental <br />Quality Act requirements in providing information about the location of hazardous materials release sites. <br />Below are the data resources that provide information regarding the facilities or sites identified as <br />meeting the Cortese List requirements. <br /> <br />3 https://caltrans.maps.arcgis.com/apps/webappviewer/index.html?id=465dfd3d807c46cc8e8057116f1aacaa. <br />
