action, he or she shall be allowed leave for the time actually <br /> required for such service, without loss of pay. Each on-duty <br /> employee called for such service shall present to his or her <br /> department head for examination the subpoena calling him or her to <br /> such service and shall pay into the City Treasury the fees <br /> collected for such service, with the exception of reimbursement for <br /> transportation expenses, if any. <br /> Section 5 . Examination Leave. Employees participating in <br /> examinations conducted during their normal working hours for <br /> positions in the competitive service of the City of Santa Ana will <br /> be granted leave with pay for the time actually required, without <br /> loss of any accrued vacation or compensatory time off benefits . <br /> Section 6 . Unauthorized Absence . Unauthorized absence from <br /> duty for any duration of time may be considered cause for <br /> dismissal . Absence from duty without leave for five (5) consecutive <br /> working days shall be deemed a resignation from the service; <br /> provided, however, if upon return to duty the person so absenting <br /> himself makes an explanation satisfactory to the department head of <br /> the cause of his absence, the department head may restore him to <br /> his position, with the City Manager' s approval . <br /> Section 7 . Authorized Absence Without Pay. Absence without pay <br /> not to exceed five (5) consecutive working days, may be authorized <br /> by the department head. Absence without pay not to exceed fifteen <br /> (15) calendar days may be authorized by the department with the <br /> approval of the City Manager. Such absences may be authorized only <br /> if in the judgment of the department head they serve the best <br /> interest of the City. <br /> Section 8 . Authorized Absence Without Pay - Long Term. Upon <br /> receipt of a written request from an employee having permanent <br /> status plus action by the department head recommending approval of <br /> the request, the City Manager may grant a leave of absence for up <br /> to six (6) months for the following reasons only, except as <br /> otherwise provided in these rules : <br /> A. Illness of the employee, or of a member of his or her <br /> immediate family residing in the employee' s household, requires <br /> that the employee move from the vicinity of the City as a remedial <br /> health measure and a designated physician indicates that such <br /> removal from the City is necessary and will not be required for <br /> longer than six (6) months; or <br /> B. The employee has been appointed by another <br /> municipality to a position of greater responsibility in a field of <br /> employment wherein the employee possesses special competence, and <br /> such appointment constitutes an advancement in responsibility and <br /> authority over that required in his/her employment with the City of <br /> Santa Ana. <br /> 29 <br />
