B . A subpoenaed employee scheduled to appear in court <br /> on City business during off-duty time may be placed <br /> on stand-by status by his or her department head or <br /> authorized representative . In the event such off- <br /> duty employee is on stand-by status during any <br /> court session and is not required to appear in <br /> court, such employees shall be compensated two (2) <br /> hours overtime, paid on a straight time basis, for <br /> each court session. Such employee may elect, in <br /> lieu of paid time, two (2) hours of compensatory <br /> time off for standby time and not appearing in <br /> court . If such off-duty employee on stand-by <br /> actually appears in court, he or she shall be <br /> compensated only as provided in Subsection A, <br /> supra. Any employee on stand-by status who fails to <br /> appear in court ready to testify within (60) <br /> minutes after notification to appear shall not <br /> receive compensation for either stand-by or for <br /> appearance . <br /> C. Notwithstanding Subsections A and B, supra, <br /> whenever an employee either commences or terminates <br /> his or her on-duty shift while he or she is <br /> appearing in court or is on stand-by status, his or <br /> her sole compensation for off-duty time spent in <br /> court or on stand-by shall be on a straight time <br /> basis paid in half-hour increments . <br /> D. The above provisions of this Section shall apply <br /> only to personnel exempted from coverage under the <br /> overtime provisions of the FLSA. <br /> E. Employees assigned to a 3/12 - 4/12 Work Schedule <br /> who appear in court during their regularly <br /> scheduled workweek, and as a result do not receive <br /> adequate rest , will be allowed to flex their <br /> scheduled shift start time up to four hours, with <br /> the approval of the employee' s immediate supervisor <br /> and watch commander, or immediate supervisor and <br /> section commander. Alternatively, the employee may <br /> be allowed to use up to four hours from his/her <br /> "Time Off Bank" or from compensatory time off at <br /> the beginning of their scheduled shift to ensure <br /> adequate rest . <br /> 8 . 15 Creation of Compensation Time Bank . <br /> A. Any member of the Association who works overtime, <br /> or has accrued but unused holidays, can designate <br /> that he or she will contribute the value of such <br /> time to a bank for use by members of the <br /> Association for the purposes and subject to the <br /> 28 <br />
