So it’s fairly light in the alley way where you are, and darker in the <br />backyard where he is? <br />GRAHAM: Correct. <br />CARVO: Were you using a flashlight or anything to shine on him? <br />GRAHAM: I don’t know if I clicked it on or not, the one that’s on my gun, I don’t remember <br />if I did or not. <br />CARVO: Okay. Okay. So you yell at him, put your hands up, and he face…he’s facing you <br />and he puts his hands up. Does he put them all the way up, elbows extended, <br />does he have them… <br />GRAHAM: Ah, he put his elbows extended. <br />CARVO: Okay. And what happens next? <br />GRAHAM: Um, and then I tell him…I order him to the ground. <br />CARVO: Okay. <br />GRAHAM: Um, and he starts to get to the ground, um, and that’s when he starts yelling <br />and then he goes to the ground in a prone position. <br />CARVO: So you order him to the ground. Did he immediately start to follow your <br />orders? <br />GRAHAM: Well, I believe I had to tell him a couple of times. <br />CARVO: Okay. Um, and what was he doing during that, during that time, while you’re <br />giving him commands and he’s not doing it right away on the first one, but <br />you’re telling him a couple of times, was he pacing, was he still standing still, <br />was he looking around… <br />GRAHAM: Standing and looking around at that point.
