In cases where areas of authority overlap, it is the responsibility of the EEO <br /> <br /> Officer to advise the complainant of the existence of State, Federal and other <br /> proper action agencies, which may also have a bearing. <br /> <br /> 3. Complainants alleging discrimination under this part will be made aware of their <br /> right to file directly with the Office of Civil Rights (OCR), U.S. Department of <br /> Labor and applicable procedures. <br /> <br /> 4. Procedures for Handling Handicap Complaints by <br /> <br /> Participants <br /> <br /> Complaints alleging discrimination on the basis of handicap will be filed and processed <br /> under the Department of Labor regulations implementing Section 504 of the <br /> Rehabilitation Act of 1973 at 29 Code of Federal Regulations Section 32. <br /> <br /> 1. Complaints must exhaust the Santa Ana LWIA's informal resolution <br /> procedures before filing their complaint with OCR. <br /> <br /> 2. Complainants will be made aware of the 180 days requirement in which to <br /> file his/her complaint. <br /> <br /> A. Procedures at the LWIA Level <br /> <br /> 1. The complainant shall file his/her complaint directly with the Santa Ana LWIA. <br /> <br /> Upon receipt of the complaint, the EEO Officer shall investigate and gather <br /> information concerning the complaint. <br /> <br /> 2. An informal conference will be held with the parties concerned in an effort to <br /> resolve the issue(s). The complainant has the right to be present and may be <br /> represented during the conference. <br /> <br /> 3.
