City of Santa Ana <br />4 y, <br />SECTION 5 <br />PERSONNEL <br />5.1 PERSONNEL REQUIREMENTS <br />5.1.1 Employee Performance <br />Contractor must employ only competent and trained personnel, and shall provide a sufficient <br />number of employees to perform the services provided under the Contract Documents. <br />Contractor must comply with all the following personnel requirements: <br />A. All of Contractor's Transportation Personnel and employees shall be sufficiently trained <br />and capable to ensure the safe and proper discharge of their service responsibilities; <br />B. All Contractor ambulance personnel must possess valid California Driver's Licenses in the <br />proper class, including any required certifications, and must be compliant with all relevant <br />provisions of the California Vehicle Code, Health and Safety Code, and all other laws <br />applicable to private, emergency ambulance response personnel; <br />C. Contractor must have an employee alcohol and drug program that includes at a minimum, <br />an alcohol and drug free workplace policy, and an employee alcohol/drug-testing program <br />that complies with the U.S. Department of Transportation requirements to the extent <br />allowed by law, including random alcohol and drug testing. Any Contractor employee <br />found working under the influence of alcohol or drugs must be immediately removed from <br />performing any further duties under the Contract Documents. The alcohol and drug <br />program must meet the following requirements: <br />i. A contract with a program administrator and authorized lab certified by the U.S. <br />Department of Transportation; <br />ii. Procedures and components substantially as in Part 40 of Title 49 of the Code of <br />Federal Regulations for pre-employment; <br />iii. Procedures and components substantially as in Part 382 of Title 49 of the Code of <br />Federal Regulations for rehabilitation, return-to-duty and follow up testing; <br />iv. Procedures and components for random testing following U.S. Department of <br />Transportation guidelines, and additional tests as required following accidents, <br />Phase 2 RFP: Emergency Ambulance Transportation and Related Services Page 1 47 <br />June 14, 2012 <br />25F-66
