2) Inform a cardholder not billed in the transaction currency of the MERCHANT that each Installment Billing Transaction <br />amount may vary due to currency conversion rate fluctuations; <br />3) Ensure that the sum of the Installment Billing Transactions does not include any finance charge or exceed the total price <br />of the goods; and <br />4) Authorize all transactions (zero floor limit). <br />B. MERCHANT must not add finance charges to an Installment Billing Transaction. <br />C. MERCHANT must not deposit the first installment Billing Transaction with TMS and BANK until the shipment date of the <br />goods. MERCHANT must deposit subsequent Installment Billing Transaction Receipts at either of the following intervals: (i) <br />30 calendar days or more, or (ii) monthly anniversary of the shipment date (same day of each month). <br />18.11 Card Identification Data (CID) (Discover): <br />A. MERCHANT is required to submit the CID with the authorization request for a Card Not Present CARD sale. MERCHANT's <br />failure to include the CID in an authorization request where required may result in a negative authorization response and may <br />increase the fees MERCHANT is obligated to pay. If MERCHANT does not submit CID with an authorization request for a <br />Card Not Present CARD sale, MERCHANT may lose a dispute of the CARD sale. MERCHANT is prohibited from retaining, <br />archiving or otherwise storing the CID in any form or format for any reason, including the recording of the CID on SALES <br />DRAFTS or the making of photocopies of the front or back of CARDS. <br />19. Vehicle Rental Authorization Procedures: <br />19.1 A special authorization procedure is available if MERCHANT estimates the transaction amount based upon cardholder's intended <br />rental length at time of rental, the applicable rental rate, tax, and/or mileage rates. Such estimated transaction amount shall not <br />include ancillary charges representing amounts to cover potential vehicle damages or insurance deductibles when cardholder <br />waives insurance at time of rental. <br />19.2 MERCHANT shall record on the SALES DRAFT the date, amount, and all authorization approvals obtained. <br />19.3 MERCHANT shall disclose to cardholder the amount authorized at the time of rental. <br />19.4 Subsequent Authorization: <br />A. If no Authorization was obtained at time of rental and MERCHANT, based upon cardholder's actual charges later estimates <br />the transaction amount will exceed the applicable floor limit, MERCHANT may obtain an Authorization approval code for the <br />new estimated amount. <br />B. MERCHANT may obtain Authorization for additional amounts (above any amount not authorized) on the car rental pick-up <br />date or prior to the car rental return date. Additional Authorization is not necessary if the sales transaction does not exceed <br />the sum of the authorized amounts plus fifteen percent (15%) of the sum of the authorized amounts. <br />20. Paper Processing Merchants: <br />20.1 Paper processing MERCHANTS shall authorize by using the established Floor Limits. Any MERCHANT that wishes to accept a <br />SALES transaction under the established Floor Limits, and which is not authorized, is liable for the resulting CHARGEBACKS <br />from those CARD numbers listed on the Electronic Exception File. <br />20.2 In the case of a MERCHANT depositing paper drafts, such drafts shall be deposited with TMS and BANK within five (5) days of <br />the SALE date. <br />21. Express Payment Services ("EPS"): <br />21.1 Any "fast food" restaurant, motion picture theater, or parking lot MERCHANT that wishes to participate in the VISA or <br />MASTERCARD EPS program must first obtain an EPS Agreement with TMS and BANK. <br />22. Travel and Entertainment ("T&E") Merchants: <br />22.1 A MERCHANT whose primary function is to provide travel related services shall be referred to as a Travel & Entertainment <br />("T&E") MERCHANT. These include but are not limited to car rental, lodging, and central reservation services. <br />22.2 A T&E MERCHANT may process delayed or amended charges if the cardholder has consented to be liable for those charges. <br />These charges may NOT include charges for loss, theft, or damage. <br />23. T&E Services: <br />23.1 A T&E MERCHANT may participate in any of the following VISA T&E Services: <br />A. Priority Check-Out Service <br />B. T&E Advance Deposit Service <br />C. T&E Cash Disbursement Service <br />D. VISA Reservation Service <br />RULES which apply to the VISA T&E Services are available upon request. <br />23.2 Priority Check-Out Service: <br />A. MERCHANT agrees to do the following for VISA transactions: <br />1) accept all VISA CARDS; <br />2) have cardholder complete, sign, and return a Priority Check-Out Agreement ("Agreement") which includes the <br />cardholder's mailing address; <br />3) complete a SALES DRAFT which includes the total SALES amount and the words "Priority Check-Out" on the signature <br />line; <br />4) review the completed Agreement and ensure the account number matches the account number on the SALES DRAFT if <br />applicable, <br />5) comply with normal Authorization and deposit requirements; <br />6) at the cardholder's request, MERCHANT must mail the SALES DRAFT copy, the itemized bill, and the signed <br />Agreement to the cardholder within three (3) business days of the cardholder's departure; and <br />201108 MTPA Terms and Conditions Page 15 of 35 CONFIDENTIAL
