Box 1988 <br />Santa Ana, CA 92702 <br />r;ECEIVED <br />1 I[ <br />SAGA AAA PUANING OF <br />Subject: City of Santa Ana— Geneva Commons —MacArthur Place Zone Change <br />Dear Mr. Fregoso: <br />During its Regular Meeting of January 15, 2004, the Airport Land Use Commission (ALUC) for Orange County <br />resumed consideration of the subject project. The matter was duly discussed, moved, seconded, and carried by <br />the Commission to find the City of Santa Ana - Geneva Commons - MacArthur Place Zone Change to be <br />Consistent with the Commission's Airport Environs Land Use Plan (AELUP) for John Wayne Airport <br />vroviding: that the project does not exceed 229' AMSL in height; and providing that the project complies fully <br />ith all conditions required by the FAA, including those discussed in the ALUC's staff reports and in the FAA <br />Determination of September 23, 2003, in particular as regards obstruction lighting and /or marking per the <br />criteria of FAA Advisory Circular 70/7460 -1 70/7460 -1K; and providing that Notice of Airport in Vicinity is <br />provided to all future occupants as specified in JWA AELUP Section 3.3.6. <br />Furthermore, the Commission finds that, although the project is technically Consistent with the JWA ALL UP, a <br />combination of factors including the proximity of aircraft overflights as well as aircraft operating procedures <br />and navigation systems, the resulting sight and sound of aircraft, and the proposed physical height coupled with <br />residential usage, make the site a poor location for such a development project. <br />Additionally, the Commission directed staff to prepare an agenda item for the next ALUC meeting scheduled <br />for February 19, 2004 for the Commission to consider applying PUC Section 21676.5 to the southeastern area <br />of Santa Ana in specific instances.
