Section 8 <br />8.13 Migratory Bird Treaty Act <br />Will the project affect protected migratory birds that are known, or have a <br />potential, to occur on-site, in the surrounding area, or in the service area? <br />Z No. Provide an explanation below. <br />Both Centennial Park and the Heritage Museum contain several trees that <br />provide nesting opportunities for migratory birds. The proposed construction <br />activities at Centennial Park and at the Heritage Museum would not remove any <br />trees that could contain active nests. Therefore, potential direct impact to nesting <br />birds would be avoided. The Proposed Project would involve the operation of <br />heavy equipment at Centennial Park and the Heritage Museum. There is the <br />potential that the operation of the heavy equipment could disrupt the breeding <br />patterns of migratory birds if they are nesting in nearby trees. To minimize noise <br />impacts to nesting birds a 24-foot high noise wall would be provided around each <br />injection well site and construction equipped would be fitted with noise reduction <br />features, such as mufflers and engine shrouds to reduce potential noise impacts <br />to nesting birds. With the implementation of Mitigation Measures BIO-I and BIO- <br />2 potential significant adverse impacts to migratory birds would be reduced to a <br />less than significant level. <br />Mitigation Measures <br />B10-1: At each well site a 24 foot noise wall would be provided around the work <br />area to minimize noise impacts. <br />BIO-2: All heavy equipment will be equipped with noise reduction features, such <br />as mufflers and engine shrouds. <br />Level of Impact after Mitigation <br />Less than significant adverse impact with Mitigation Measure B10-1 and 610-2 <br />8.14 Protection of Wetlands <br />Does any portion of the project boundaries contain areas that should be <br />evaluated for wetland delineation or require a permit from the United States <br />Army Corps of Engineers? <br />Wetland Waters are a subset of jurisdictional Waters of the U.S. and! the State. <br />Generally, wetlands are lands where saturation with water is the dominant factor <br />determining the nature of soil development and the types of plant and animal <br />communities living in the soil and on its surface. Presently, there is no single <br />definition of wetlands recognized by the state and the federal government <br />However, the state and federal definitions do share common terms and concepts. <br />For purposes of this classification, wetlands must have one or more of the <br />Mid Basin Centennial Park roject Final <br />
