3.0 RULES OF OPERATION <br />3.1 Contractual Obligations: The City shall require certain contractual obligations, which <br />may include, but are not limited to the following: <br />Inclusion of Proposal: The proposal submitted in response to this RFP <br />shall be a required part of the final agreement with the selected proposer. <br />3.2 Acreement: A resulting agreement shall include any written material made as part of <br />your proposal. This material may include but is not limited to: answers to questions <br />contained in this RFP, letters, telegrams, facsimile and product literature. <br />3.3 Closed Shop Agreement: Contractor agrees to provide union member only <br />employees for the entire duration of the agreement. Union is defined as an organized <br />association of workers, formed to protect and further the rights and interests of the <br />worker. <br />3.4 Labor Relations: Contractor shall be responsible for its own labor relationships and <br />shall negotiate and be responsible for resolving any and all disputes between itself <br />and its employees or any union representing its employees. Whenever Contractor <br />has knowledge that any actual or potential labor dispute is delaying, will delay, or <br />threatens to delay, the timely performance of services under this contract, Contractor <br />shall immediately give written notice thereof to the Police Administrative Manager, or <br />designee. It shall be the Contractor's responsibility to provide continuous services, <br />without interruption, to all buildings and facilities specified herein throughout the term <br />of the contract. In the event of a labor strike, Contractor shall provide the means, at <br />Contractor's expense, to provide continuous services in full compliance with contract <br />requirements. Failure to do so will cause the City to take whatever action is <br />necessary to provide the services. If, in doing so, City incurs costs in excess of those <br />that would have been paid to the Contractor for the same services, these excessive <br />costs shall be paid by the Contractor. <br />3.5 Labor Regulations: The contractor shall comply with all applicable requirements of <br />the California Labor Code, specifically Labor Code Sections 1060-1065, regarding <br />displaced janitors. It is the Contractor's responsibility to review this legislation and be <br />familiarized with its content accordingly. <br />3.6 Changes to Terms & Conditions: Proposers are to submit, as part of their proposal, <br />any changes or modifications to the terms and conditions they may wish the City to <br />consider. Proposers are encouraged to offer any other options, with the <br />understanding that their proposal shall first address the RFP requirements. Options <br />are to be identified as such. <br />3.7 Errors and Omissions: Proposer shall not be allowed to take advantage of any errors <br />or omissions in the RFP. Full instructions will be given if such error or omission is <br />discovered and called to the attention of the City in a timely manner. <br />4.0 OTHER GENERAL CONDITIONS <br />4.1 Point of Contact: The Proposer's on -site Supervisor or designee shall be the primary <br />point of contact with the Santa Ana Police Administrative Manager or designee. <br />During times when the Proposer's supervisor is not cn-site, the point of contact shall <br />be the Proposer's Agreement Administrator.
